Dabholkar-Pansare murders: Bombay HC asks CBI to be extra-cautious and not be misled

The Bombay High Court has asked the Special Investigation team and Central Bureau of Investigation (CBI), probing the murders of Govind Pansare and Dr Narendra Dabholkar, case to be extra cautious and not abandon their independent probes, ongoing for five years, because of arrest of some accused, which they are now claiming to be prime accused in the two cases.

A division bench of Justice S C Dharmadhikari and Justice B P Colabawala, said "Don't be clueless, don't abandon your past theories, there could be attempts to mislead you."

The observation was made after the CBI counsel Additional Solicitor General, Anil Singh said that few accused arrested in the Nalasopara arms haul case were being probed for their role in the Dabholkar murder case. SIT also informed the court that after the probe is over they would take custody of the arrested accused.  

The bench said "Pansare murder case has different repercussions. Those elements will have to be probed independently. You (SIT) cannot stop now." Counsel for SIT, Ashok Mundargi, assured the court that independent efforts are being made and nothing is taken at face value.

The bench also warned the officers of the CBI, SIT to not divulge case details to the media. "What is all this hue and cry going on. What are these reports coming in the press, at whose instance are they coming? We hope you know these are crucial stages. There seems to be total lack of maturity on the behalf of media and family members of the deceased. We are not happy with what is going on."

Singh and Mundargi assured the court that it has instructed its advocates and officers not to share probe details, as the case is being heard before the court. However, bench reminded them that "Even the accused have certain rights. It is not the accused who have to prove the case against them. Accused today, may not be convicts tomorrow, it is a tedious process, their (accused) and family members will be affected."

The bench was hearing petitions seeking court monitoring of the probes. Recently, the CBI has got custody of two accused Sharad Kalaskar and Sachin Andure, Rajesh Bangera, Amit Degvekar and Amol Kale. The CBI previously arrested Virendrasinh Tawde.

The court has now posted the matter for further hearing to October 10, directing them to file further, progress report. Recently, State ATS has arrested few people from Nalasopara for being in possession of huge cache of arms and ammunitions.

Dabholkar, was shot dead on August 20, 2013 in Pune while on a morning walk. Pansare was shot at on February 16, 2015 in Kolhapur and had succumbed to his injuries on February.
