A Delhi court on Friday summoned Reliance ADAG chairperson Anil Ambani, his wife Tina Ambani and 11 others in the 2G spectrum allocation case. They been directed to appear in court on Monday as prosecution witnesses. On Wednesday, special CBI Judge OP Saini had reserved order on a CBI plea to make them prosecution witnesses.
Special public prosecutor UU Lalit told the court that Ambani would be a crucial witness as he would be able to “throw light” on the alleged investment of over Rs990 crore by Reliance ADAG companies in Swan Telecom Pvt Ltd, which is facing trial in the case along with its promoters Shahid Usman Balwa and Vinod Goenka. Three top Reliance ADAG executives, Gautam Doshi, Surendra Pipara and Hari Nair, are also facing trial in the case. But Sidharth Aggarwal, appearing for Reliance ADAG, opposed the CBI plea and said, “The fact that this application has come out at the fag end of the trial shows this is not important.”
On Friday, the court noted that both Anil and Tina held responsible positions in Reliance ADAG, and their testimonies could prove beneficial to the trail.
“Both these witnesses, that is, Anil D Ambani and Tina A Ambani are holding responsible positions in Reliance ADA group and the shell companies... As such, their examination cannot be said to be totally unnecessary or unconnected with the case. Rather it may help in reaching the truth and just decision of the case,” the court said.
The court added: “After going through the facts pertaining to incorporation of shell companies and investment or divestment by the companies, I also find that witnesses already examined have failed to prove most of these facts... I find that the examination of these witnesses is essential for the just decision of the case.
Accordingly, application is allowed and the prosecution (CBI) is directed to summon these witnesses.”
