Court rejects plea against RCA Ombudsman

In a string of legal victories over Dr C P Joshi-led Rajasthan Cricket Association, the Lalit Modi group won another battle on Friday when the single bench of Justice JK Ranka dismissed a petition filed by Mahender Nahar, Joint Secretary RCA, challenging the authority of RCA Ombudsman Justice Gyansudha Mishra and seeking recall of the High Court order holding her as supreme authority to decide disputes within the RCA.

Hence the authority of the Ombudsman appointed under the Lodha Committee recommendations has been finally upheld by the high court and now it is no longer open to members of RCA to sit in judgment individually or collectively about the role, jurisdiction and authority of the Ombudsman.

This is being considered a second legal setback to RCA President Joshi in many days as on Thursday night, Ombudsman Mishra had revoked the suspension of RS Nandu from the post of secretary.

In an earlier hearing few days ago, the court had reinstated Ombudsman Mishra and ordered both the legal officers to resume their posts.

Commenting on the judgment, Mehmood Abdi, former deputy president of RCA, said "The order of the High Court has further strengthened the rule of law and implementation of the Lodha Committee reforms in affairs of RCA."

While the Friday order puts Ombudsman firmly in the RCA, her order on revoking of suspension of Nandu given on Thursday late night is also seen as a a shot in arm for the Modi group.
