The Congress party has alleged that the then protem speaker Sidharth Kuncalienker accepted Vishwajeet Rane's resignation as MLA to save him from disqualification.

Vishwajeet had resigned from Congress within minutes of being sworn in as an MLA in the assembly in March. The proceedings were handled by then Panaji MLA Sidharth. Sidharth too later resigned as MLA to pave way for CM Manohar Parrikar's by-election. Congress had then filed a disqualification petition against Rane in the high court; arguments on which began on Thursday.

The Congress submitted before the high court that it has approached the court as Rane is no longer an MLA. So the speaker has no jurisdiction to hear the petition.

"The speaker should have examined the resignation before accepting it. But it was accepted immediately to protect him from facing disqualification. Vishwajeet connived with the protem speaker," Congress argued in the high court.

Rane's lawyer however maintained that any matter regarding the member of a legislative assembly should come before the speaker. "The Congress should first petition the speaker," he told the court.

Advocate General of the State, Dattaprasad Lawande too asserted that the high court has no role to play till the speaker hears and disposes a petition of this nature.

The matter will again come up for hearing on next Thursday. Vishwajeet Rane is currently Health Minister of Goa.

By-election in his constituency Valpoi will be held along with Manohar Parrikar's in Panaji.
