A day after the presser by Judge Loya's son Anuj, in which he dismissed any suspicion over his father's death, the Congress brought out contradictions in various statements given by his family earlier and demanded an impartial high court or Supreme Court monitored probe.

"These various contradictory statements regarding the death of Justice Loya are reason enough for a fair probe," said Congress spokesperson Abhishek Manu Singhvi, reading out the statements of Judge Loya's family.

"On February, 2015, Anuj had written... I told him everything related to dad's death and have also asked him to set up an inquiry commission. I hereby state that if anything unnatural or whatever happens to anyone in my family, grandfather, grandmother, my sister, my mom or me, Chief Justice Mohit Shah will be responsible for it," said Singhvi reading out Anuj Loya's statement.

Singhvi insisted that the Congress was not playing any politics but only doing its duty of stating its position.

"We are not politicising Justice Loya's death....The country is demanding an inquiry into Judge Loya's death....we as a responsible stakeholder of Indian democracy, as a party, asking for an inquiry and putting before you the absolute patent paradoxes and contradictions in the diverse statements," said Singhvi adding there is no harm if an inquiry is conducted impartially and it is necessary to bring out the truth in the case.

On Sunday, a day after four Supreme Court judges expressed their reservations to the CJI Dipak Misra about assigning Judge Loya's case, Anuj Loya had that his family was pained by what was happening over his father's death and asked NGOs, media and politicians to stop harassing his family members.

Judge Loya, who was hearing Sohrabuddin encounter case in which BJP chief Amit Shah was one of the accused, had died on December 1, 2014 ostensibly of "cardiac arrest" in Nagpur, where he had gone to attend a wedding. Fifteen days later, Judge M B Gosavi, who replaced Loya, discharged Amit Shah on December 30, 2014.
