Citizenship row: Plea in Supreme Court to scrap Rahul Gandhi's poll nomination

Congress President Rahul Gandhi faced fresh trouble over his citizenship on Thursday as a petition was filed in Supreme Court demanding the scrapping of his nomination till the ongoing inquiry into his citizenship initiated by the Ministry of Home Affairs is over.

Additionally, the petition has demanded that his name be dropped from the voters' list.

The petition has been filed by two persons associated with the Bharatiya Janata Party (BJP) and the Hindu Mahasabha, namely Jai Bhagwan Goyal and Chandra Prakash Tyagi. The petition was mentioned for urgent hearing on Thursday before a bench headed by Chief Justice Ranjan Gogoi. Since the matter could not be filed by then, the Court asked the petitioners to wait till the matter is listed.

The petitioners relied on a letter written by BJP leader Subramanian Swamy to the Ministry of Home Affairs on November 12, 2015 providing evidence that suggested Gandhi is a British citizen. The letter attached a certification of incorporation issued by the Registrar of Companies at England, Wales of a company called Backops Limited. The 2003 document names Rahul as a British national and one of the promoters of the company with the residential address — 51, Southgate Street, Hampshire. The company was dissolved on July 1, 2009.

According to the petition, while contesting the parliamentary elections in 2009 and 2014, Rahul concealed this information. It demanded that his present nominations filed for 2019 elections to Parliamentary seats of Amethi and Wayanad be debarred. In addition, as per Section 16 of the Representation of Peoples Act, the petition also sought his name to be deleted from the voters' list as a non-citizen cannot vote in elections.

The Ministry of Home Affairs recently issued a notice to Rahul asking for his response on the claim of his British citizenship. The petition is crucial in that the Court could decide to issue a notice to the Centre and Election Commission.
