Child rights’ panel in progress: Gujarat

The state government has filed an affidavit before the Gujarat high court stating that it is actively considering the issue of formation of a commission for protection of child rights. It has further stated that it will inform the high court as and when the commission
is formed.

The affidavit was filed by Haresh Shah, in-charge undersecretary of women and child development department, following a petition by the Dalit Hitrakshak Mandal.

The petitioner had sought for the formation of an independent commission for protection of children under section 17 of the Protection of Child Rights Act 2005.

This petition was filed after the government, through a notification dated April 7, 2011, instead of forming an independent commission for protection of children, gave charge of the same to the already over-burdened women's commission.

The commission was also expected to ensure proper implementation of the Right to Education (RTE) Act. Ideally this work comes under the commission for protection of child rights. It should be noted that after the 2005 Act came into force nine states in the country formed a commission for protection of child rights.

Counsel for the petitioner Bhushan Oza said that the women's commission is already overloaded with work. "Moreover, with the merging of the two there is a possibility of conflict," he said.

Oza further said that though the government has filed an affidavit stating that the formation of the independent commission is under consideration it has not set the time by which the said commission will be formed.
