Bombay High Court sees no meat in BMC move; Shiv Sena, MNS defy ban

On a day when Shiv Sena and MNS defied the Brihanmumbai Municipal Corporation's (BMC) four-day meat ban during Jain festival of Paryushan, and resorted to open sales, the Bombay high court too stepped in, questioning the feasibility of such a decision.

"Is it a feasible decision (BMC) to impose ban on meat for four days in a city like Mumbai," the court asked, hearing a petition filed by the Bombay Mutton Dealers' Association challenging the ban.

"Mumbai is a metropolitan city. Such straight jacket ban on meat cannot be done. Ban is on slaughter and sale of the meat. What about other sources through which meat can be availed? What about packaged meat that is already available in the market?," a division bench consisting of Justice Anoop Mohta and Justice AA Sayed asked. It further directed the BMC and the state government to file a response on Friday.

When the government counsel clarified that the ban is not a new thing and a two-day ban is being imposed since 2004, the court asked the corporation why it had extended the ban to four days (Sept 10, 13, 17 & 18). The court also asked the civic body to clarify whether chicken too is banned as the order only states 'meat ban', with an exemption on fish and eggs.

The court asked if the Jain community had a problem, why a directive could not be issued against open slaughtering and display of meat in shops.

The court also asked the government and civic body under what provisions it imposed the ban. The petitioners claimed that the decision is unconstitutional and favours a small percentage of population, besides going against the secular fabric of the country.
