Bombay HC directs to remove all illegal structures at entrance of Haji Ali Dargah

All illegal structures that have come up at the entrance of the walkway to the iconic Haji Ali Dargah must be removed within three months, the Bombay High Court has ruled.

A division bench, comprising of Chief Justice Manjula Chellur and Justice GS Kulkarni, on Friday, also asked the Mumbai Collector and the Brihanmumbai Municipal Corporation (BMC) to form a joint task force and take the assistance of the police to reclaim the government land.

The HC directive came while disposing of a public interest litigation (PIL) filed by Sahayak, an NGO, seeking appropriate action against the unauthorised structures near Haji Ali Dargah.

The petition filed through Advocate Ashish Mehta had stated that several letters were written to officials in the G ward and police authorities informing them about a temporary structures being erected at Haji Ali, on Collector’s land which comes under Coastal Regulation Zone (CRZ). However, it was claimed that the Collector of Mumbai and the civic body kept passing the buck to each other in demolishing the said ‘illegal’ and ‘unauthorized’ structures near the Dargah.

Mehta said the state has issued a Government Resolution on May 5, 2011 wherein it has categorically stated that any illegal construction carried out in or near religious premises has to be demolished if the said construction is built after September 29, 2009. However, neither the collector nor the BMC took action against the said structure in accordance with the law.

Advocate Shoeib Memon appearing for the Haji Ali dargah Trust said, "He was not present in court at the time of the order and only after he receives the court order will he be able to comment on the issue, and whether the trust would appeal against it or not."
