Facing criticism, Bihar govt rethinks 'harsh' provisions of new prohibition law

All the laws that have been adopted following the ruling have been deemed too harsh.

Barely a month after the Bihar government enforced a harsher Bihar Prohibition and Excise Act, 2016, labelled 'Talibani' by some sections of the society, the Nitish Kumar led Mahagathbandhan government seems to be rethinking the provisions of the new law and has issued a public notice asking people to pitch forth constructive suggestions for smoother implementation of the law.

The new law, which came into effect on the occasion of Gandhi Jayanti on October 2, has provisions such as action against all adult members of the family if liquor is found on their premises or anyone is suspected to have consumed it, imposing collective fine, prosecuting the owner of liquor is stored on any premises and sanctioning Excise and police officials to enter any premises without warrants as well as sealing or confiscating properties.

It may also be mentioned that all sections in the new Act are non-bailable. Such stringent provisions, along with CM Nitish Kumar himself championing the agenda, created nationwide interest in it.

According to the notice issued by state excise commission, people have been asked to provide their suggestions on email id feedbackprohibitionbihar@gmail.com or on cell number 9473400378, FAX number 0612-2205871 or by post to excise office, new secretariat, Patna. “While a lot has been talked and written about new law, with many questioning its provisions terming it very harsh, we invite solid measures which may help in better implementation of the law,” the notice reads. The last day for providing feedback is November 12.

The state government has maintained that it has gone into the public domain to take suggestion from the common people, who matter the most in a democracy, the Opposition BJP has alleged that the Bihar government has done it an attempt to save its face before the Supreme Court, where the old Bihar Excise (Amendment) Act, 2016, quashed by Patna high court is being heard. Even the new law has been challenged in the Patna High Court.

Sources said the state government may bring any amendments, is considered in the winter session of Bihar legislature, likely to commence in the last week of November.
