Babri Masjid case: Judge seeks promotion, Supreme Court asks for case update

With the case to be heard and decided in two years, the top court had ordered that Special CBI Judge SK Yadav should not be transferred. Thus, Allahabad High Court denied his request for a promotion as District Judge.

The Supreme Court's (SC) April 2017 order directing fast-track hearing of the Babri Masjid demolition case has slowed down the career of the trial judge hearing the case. With the case to be heard and decided in two years, the top court had ordered that Special CBI Judge SK Yadav should not be transferred. Thus, Allahabad High Court denied his request for a promotion as District Judge.

Yadav then approached SC, which gave the top court the opportunity to ask him for updates on the case. On Monday, the bench comprising Justices RF Nariman and Indu Malhotra directed Judge Yadav to submit a progress report within a month.

On April 19, 2017 the Supreme Court had directed that the trial against L K Advani and Murli Manohar Joshi, Vinay Katiyar, Uma Bharati, Sadhvi Rithambara and Vishnu Hari Dalmia be shifted from Rae Bareilly court to Lucknow court, where the case against other kar sevaks accused in the Babri Masjid was pending. The top court had ordered that the day-to-day trial in the case be completed within two years. In addition, Judge Yadav's transfer was halted till the trial was over.

The Special CBI Judge was promoted as District Judge. Coincidentally, his case was listed before a bench headed by Justice Rohington F Nariman, who was the author of the order passed in 2017. Justice Nariman issued notice on Judge Yadav's petition, seeking a response from the Uttar Pradesh government.

  • In April 2017,  the apex court directed day-to-day trial in the Babri case to be completed within two years. 
  • It also put the transfer of Special CBI Judge SK Yadav hearing the case till the completion of trial on hold. 
  • SC directed the trial to be shifted from Rae Bareilly court to Lucknow court 
  • CBI told to file additional charges against accused before Lucknow court
