Arvind Kejriwal present, Jaitley absent in court

Jaitley has slammed Kejriwal and five other members of the Aam Aadmi Party (AAP) in a criminal defamation case and a civil defamation case. Ashutosh Bhardwaj, Kumar Vishwas, Deepak Bajpai, Sanjay Singh and Raghav Chadha are also named in the complaint.

Senior advocate Ram Jethmalani, appearing for Delhi chief minister Arvind Kejriwal in the defamation case against union finance minister Arun Jaitley, appealed for a temporary adjournment of trial that was denied by the chief metropolitan magistrate (CMM).

"Adjourn the matter, so that I can approach the High Court in this regard... I don't want to face both the cases simultaneously," Jethmalani said. Disposing off the application, CMM Sumit Das stated, "In my opinion the civil suit for damages on account for defamation and criminal defamation case both stands on different footing and can be tried simultaneously."

Jaitley has slammed Kejriwal and five other members of the Aam Aadmi Party (AAP) in a criminal defamation case and a civil defamation case. Ashutosh Bhardwaj, Kumar Vishwas, Deepak Bajpai, Sanjay Singh and Raghav Chadha are also named in the complaint.

The court also directed the complainant's counsel to supply copies of the documents, filed along with the complaint to the accused persons. "In the larger interest of justice and to cut short the controversy and to enable the accused to address arguments on the point of notice/to avoid prejudice to the accused, let another set of documents complete in all respects be supplied," the court said. Responding to the allegation, Siddharth Luthra, appearing for Jaitley submitted that in so far as the documents are concerned, two sets of copies have already been supplied, and Phoolka's plea was nothing but a tactic to seek more time or to "protract the trial and delay the case."

CMM Das has set the next date for hearing on July 16, when arguments on the notice will be heard.

In December 2015, the finance minister had filed a criminal defamation suit against Kejriwal, after the Chief Minister had alleged in a press conference that Jaitley - who headed the Delhi and District Cricket Association (DDCA) for 13 years, had profited from his alleged relationship with a firm called 21st Century Media Private Limited, a sports management firm. A civil defamation suit seeking damages worth Rs. 10 crores has also been filed in the HC. The matter for which is pending.

Apart from this case, Kejriwal has been accused of defamation in two other cases. Union transport minister Nitin Gadkari, and Kapil Sibal's son Amit have also filed defamation suits against Kejriwal.
