After Election Commission ban, PM Narendra Modi biopic debate back in top court

The reviewed order will now be shared with the court in a sealed cover by Friday, following which the matter will be heard on Monday.

After the Election Commission imposed a ban on the release of Prime Minister Narendra Modi biopic, the Supreme Court on Monday stepped in — at the instance of the film's producers — and directed the Election Commission to first view the film to pass an order. The reviewed order will now be shared with the court in a sealed cover by Friday, following which the matter will be heard on Monday.

This is the second round of litigation regarding the film in the Supreme Court. In the first round, the challenge against the movie titled 'PM Narendra Modi' was brought by a Congress activist. The Court had then dismissed the petition, asking the petitioner to approach the Election Commission as the film was yet to be cleared by the Central Board of Film Certification (CBFC). The Court said that any decision on whether the film violates Model Code of Conduct was best left to the EC.

Following this, on April 10, the EC ordered a ban on the screening of the film in the interest of maintaining free and fair elections. However, challenging this, the producer of the film Sandeep Vinod Kumar Singh approached the apex court that the EC decision was based on viewing of the trailer and not the entire film.

Senior advocate Mukul Rohatgi, on behalf of the producer, informed the court that they were willing to share a copy with the EC to enable a review of the ban. The bench agreed with the suggestion and said, "Without commenting on merits of the order of the EC, at this stage, we would like the EC or its authorised representative to view the movie and thereafter consider the matter of public screening of the movie once again."

The film producers breathed a sigh of relief as the film has already missed its second scheduled release date of April 13. The film has actor Vivek Oberoi playing the lead role as PM Modi.
