Anita Advani, who claims to have been the live-in partner of late actor Rajesh Khanna, on Thursday sought that an application filed against her by Dimple Kapadia, her two daughters and son-in-law Akshay Kumar should be heard before a special court headed by a woman judge.

Soon after the death of Khanna last year, Anita had filed a case against Dimple and her family under the Protection of Women from Domestic Violence Act.

Justice KU Chandiwal was informed by Advani’s counsel Manohar Shetty that the matter was placed wrongly on board and it should be heard by a special court.

Justice Chandiwal accordingly directed the registry to place the matter before the appropriate bench and directed that the interim relief in the matter — stay on the summons issued by Bandra magistrate court, directing Kapadia and others to remain present before it to continue.

Kapadia had moved the Bombay High Court for quashing a case of domestic violence filed against her and family by a woman claiming to have been in a live-in relationship with the late superstar.

Advani, in her complaint against Kapadia and others, has claimed she was driven out of Khanna’s Bandra bungalow “Ashirwad” after his death and sought maintenance from the actor’s estate. In her petition, Kapadia has contended that she was the legally wedded wife of Khanna and as such no other woman can claim share in the wealth left behind by her husband.

Kapadia also challenged the notices issued to her and family members by a Bandra magistrate on Advani’s complaint alleging domestic violence and seeking monthly maintenance from Khanna’s estate.

The petition filed by Kapadia claims that it was “unreasonable” for the magistrate to even suggest that she and her family go in for a compromise with the complainant in which case he would refer the matter for mediation.
