Bombay High Court grants bail to Rahul in Pratyusha case

The Bombay High Court on Monday granted anticipatory bail to Rahul Raj Singh, live-in partner of deceased actress Pratyusha Banerjee who committed suicide early this month. Singh has been charged for abetment of suicide.

Justice Mridula Bhatkar granted anticipatory bail to Singh on a personal bond of Rs30,000 and directed him to appear before the investigating agency on every Monday, Thursday and Saturday between 11am and 2pm for the next two weeks and then as and when called. The court observed "There should be instigation or provocation to commit the act of abetment and the prosecution has failed to prove it. Unless the mens rea of the person, who is held responsible, is brought on record prima facie it can't be said it is an abetment of suicide."

The police, however, argued before the court that it was suspecting some foul play in the suicide of Pratyusha and was considering applying the serious charge of murder against Singh.

Special public prosecutor Nilesh Pawaskar, appearing for the police, informed the court that circumstances like the dupatta of the deceased with which she committed suicide by hanging herself to the ceiling fan was found to be lying on the bed. In normal circumstances, if the dupatta was cut to release the body from it one part should have been attached to the fan. Further, Singh is alleged to be a drug addict and witness statement show that he had allegedly purchased drugs, it thus needs to be found that whether Singh was only a consumer or a drug peddler.

The prosecution also opposed the plea on the grounds that Singh and Pratyusha were staying together as live-in partners and he used to harass her, demand money and at times used to withdraw money from her bank account. He used to physically assault her because of which she took the extreme step of ending her life.

The 25-year-old TV actor was found hanging at her residence on April 1, the Bangur Nagar police have booked her live-in partner, Rahul Raj, for driving her to commit suicide. After Dindoshi session's court rejected his anticipatory bail plea, he had moved high court seeking protection from arrest.
