Live Updates: Bombay HC allows release of Udta Punjab after deleting Shahid Kapoor's public urinating scene

The Bombay High Court has pronounced its order on the censorship of 'Udta Punjab', a film highlighting the rampant drug menace and its impact on the youth in the state. It has allowed release of the movie after changing disclaimer and deleting scene in which Shahid Kapoor is seen urinating in front of the crowd.

A Division Bench of Justices SC Dharmadhikari and Shalini Phansalkar Joshi heard the plea filed by Udta Punjab's co-producer Phantom Films against the 13 cuts suggested by the Central Board of Film Certification (CBFC) in the movie.

The court also said that they doesn't find anything in the film that shows Punjab in bad light or affects the sovereignty or integrity of India as claimed by CBFC.

Earlier, the High Court told the CBFC that the multiplex audience is mature enough, adding that people should be allowed to see the film as everybody has a choice.

When the board went on to justify all the 13 cuts saying the film was meant for public exhibition, the High Court said the CBFC should only certify a film and not censor it.

In its order, Bombay HC suggested that there is no need to delete the scratching scene from a song as asked by CBFC.

Bombay HC also directed CBFC to issue a fresh disclaimer to Udta Punjab in 2 days. It also refused a stay on the film as suggested by CBFC.

# Punjab is land of green revolution, brave soldiers. One sentence (Zameen banjar te aulaad kanjar) can't affect that image.

# On cut no 9 (Tommy Singh urinating in front of crowd) ,we don't feel that this scene is necessary.

# High Court set aside cuts no 1, 2 & 3 suggested by CBFC.

# Film has to be seen in entirety and expletive words used should be seen that it does not offend sensibilities, says the court.

Creative freedom should not be unnecessarily curbed; nobody can dictate to a filmmaker about the content of his film.

CBFC's powers to cut, delete or change scenes must be consistently in consonance with provisions of the Constitution and Supreme Court order,
