Victim's father moves HC against bail pleas

Varun Kumar Thakur, father of seven-year-old murder victim Pradyuman Thakur, on Wednesday filed an intervention application in the Bombay High Court opposing the transit anticipatory bail applications moved by Ryan International group's CEO Ryan Pinto and his parents Augustine Pinto, founding chairman of the group; and Grace Pinto, its managing director.

The application, filed through lawyer Sushil Tekriwal, urges the Bombay High court to reject the pre-arrest bail applications of the trustees, claiming that they need to undergo detailed police interrogation.

The court, however, refused to hear the matter as Tekriwal failed to send copies of the intervention application to the lawyers of the accused. The court has adjourned the matter to September 14, and has extended the interim protection granted to the three trustees till Thursday.

Describing the crime as a "brutal, diabolic, cold blooded, barbarous, demonic, unpardonable, unprovoked, hellish, cruel homicide", the application claimed that the school's attitude after the offense was "remorseless, spineless and senseless, and thus they (the trustees) should not be given bail."

The application contends, "The collective conscience of the whole nation has been shaken and shattered because of this case. The commercialization of education, the rampant corruption prevalent in the academic institutions, the serious breach of regulations, rules and statutes, the lacklustre approach and attitude of the management and executives of the school, and the circulation of such atmosphere full of insecurity of each and every child going to the school, are some of the issues which are caused and affected by the top management of the school, and hence the management is vicariously liable and responsible in the case."

The application asks, "If the top management of the school can share in the plunder and prosperity, then why are they susceptible in subjecting themselves to the clutches of law and to the vicarious liability when, because of them, incidents like that of Pradyuman took place within the walls of the school?"

The three trustees have maintained that though the death of the boy is unfortunate, the management cannot be held culpable, and that they themselves were victims of the unfortunate circumstances.
