Send waste disposal draft by-laws to L-G: Delhi High Court to govt

The Delhi High Court (HC) on Tuesday gave a go-ahead for a set of draft by-laws on waste disposal, which include user fees for municipal services, among other things.

A Bench of Acting Chief Justice Gita Mittal and Justice C Harishankar directed the counsel for Delhi government to send the by-laws to Lieutenant-Governor (LG) Anil Baijal for immediate notification.

The by-laws, which have been framed by local authorities and environmental experts, provide for enforcing segregation of waste from houses and residential societies, strengthening of waste collection, storage, transportation, and processing systems and imposing of penalties for littering or violating rules.

The by-laws were framed on the orders of court experts working for environment, such as Sunita Narain, Almitra Patel, and M C Mehta, who had said that the major challenge faced in solid waste management was the lack of such provisions.

The court was looking into the issue of solid waste management as it was of the view that garbage and lack of cleanliness contributed to spread of vector-borne diseases, such as dengue and chikungunya.

The court was hearing two petitions filed by lawyers Arpit Bhargava and Gauri Grover, who had sought directions to municipal bodies and other authorities to take steps to prevent the spread of dengue, chikungunya, and malaria.

The by-laws provide for enforcing segregation of waste from houses and residential societies, strengthening of waste collection, storage, transportation, and processing systems and imposing of penalties for littering or violating rules.
