SC directs AIIMS doctor to monitor 8 month-old baby's treatment

A bench of Chief Justice of India Dipak Misra also directed the secretary of the Delhi Legal Service Association (DLSA) to accompany the two doctors and submit a report by Thursday.

Expressing their concern over the rape of an eight-month-old in the national capital, the Supreme Court has directed two doctors from the All India Institute of Medical Science (AIIMS) to assess the situation and decide whether the toddler needs to be shifted to a different facility for better treatment.

A bench of Chief Justice of India Dipak Misra also directed the secretary of the Delhi Legal Service Association (DLSA) to accompany the two doctors and submit a report by Thursday.

"In case they decide that the child should be shifted, they shall shift the child immediately to AIIMS under their personal supervision and make suitable arrangements," the bench that also comprised Justices AM Khanwilkar and DY Chandrachud said.

The top court relied on a previous judgment where it was observed that "it is the obligation of the law and law-makers to cultivate respect for the children and especially the girl children who are treated with such barbarity and savageness as indicated earlier...In the light of the said decision, we part with the suggestion with the fond hope that Parliament would respond to the agony of the collective, for it really deserves consideration. We say no more on this score."

The apex court's direction came when Alakh Alok Srivastava mentioned the matter in court on Wednesday morning. In his petition, Srivastava submitted that in cases of such brutal sexual offence, the State has to show concern and appropriate treatment has to be given to the child apart from grant of compensation.
