The Delhi High Court (HC) has sought a reply from the Airport Authority of India (AAI) as to why the Safdarjung Airport should not be attached to recover an amount of over Rs 1 crore due towards a private company.
Justice Jayant Nath issued a notice to the AAI on an execution petition filed by advocate Arpit Bhargava on behalf of his client. The company is engaged in the consultancy business and offered their services in construction of Trivandrum Airport to AAI.
Following some disputes with respect to payment, the matter was referred to Sole Arbitrator OP Goel. On December 23, 2015, the arbitrator held the contentions of the consultancy company right and awarded them a sum of Rs 1,23,67,951. He also said that an interest at 12 per cent be given, if the amount is not paid within a reasonable period as defined by the arbitral award.On May 30, Justice Vibhu Bhakru upheld the directions passed by the arbitrator after the AAI challenged the arbitral award in the high court. Following this, two letters were written by the company but there was no response from the AAI officials.
Aggrieved by the non-responsive nature of the AAI, the company filed an execution petition through their counsel demanding the attachment of the Rajiv Gandhi Bhawan, Safdarjung Airport, New Delhi to recover the amount of Rs 1, 23, 67,951 along with interest at the rate of 12 per cent per annum, from the date of passing of award till the date of payment.
"One crore forty-nine lakhs twenty thousand six hundred ninety six only together with interest on the principal sum up to the date of payment be realized by attachment and sale of immovable assets & properties of Judgment Debtor," the petition said.
Following this plea, the court on September 29 issued a notice to the AAI. The counsel for the AAI sought some time from the court to take instructions regarding the payment of the award amount, thereby fixing the next date of hearing on October 30.
