NHRC demands fake encounter report

Uttar Pradesh calling for a fact finding report regarding the alleged encounter.

The killing of an alleged gangster, Sumit Gurjar, in an encounter by police in Gautam Budh Nagar, in Greater Noida, on Tuesday, has come to the notice of the National Human Rights Commission (NHRC) who have taken suo motu cognizance of the matter.

The NHRC has issued notices to the Chief Secretary and the Director General of Police (DGP), Uttar Pradesh calling for a fact finding report regarding the alleged encounter.

On Wednesday, family members of Gurjar had alleged that the police staged an"encounter" in which he was killed. According to the family, he was killed shortly after the police had picked him up from a market on September 30. However, the police has denied this claim. According to them they chanced upon Gurjar, along with three other unidentified men, in the area. The police claims that Gurjar fired at them first.
   
Post Gurjar's death, members of his family, along with locals from his village in Baghpat, protested against the police encounter near the mortuary in Noida. They blocked the traffic at Mahamaya flyover for about 45 minutes.

The NHRC has observed that if the allegations levelled by the family members and the villagers are true, this will raise a serious issue of "violation of human rights" of the deceased and the aggrieved family.

"Carrying out an encounter of a criminal in such an unlawful manner can never send a good message to a civilised society. The police do not have a right to take away life of a human being. It is not the lawful way to deal with criminals. It has happened again and again over time," said a member of the commission.

Sumit Gurjar was shot dead by police on Tuesday night, in a late night encounter in the Chi-4 area of Greater Noida. According to police, he fell into a trap along with three other accomplices, who in the darkness, managed to flee from the site.

Police said the deceased was wanted in a case of double murder and robbery. However, the family heard the news when they watched it on television.
