Man acquitted as daughter refutes father's testimony

A man was acquitted by a court on the charges of kidnapping a minor after the girl turned hostile and said that she left the house of her own will because she was continuously being beaten by her father

Additional Sessions Judge Pawan Kumar Matto made the observation after the girl deposed in court that she had not been forcibly taken by the accused Nand Kishore, her neighbour, and a native of Bihar, as alleged by her father, a resident of Mundka.

The complainant had alleged that his daughter was kidnapped by the accused on July 4, 2016 and taken to Jalandhar where he was in search of an opportunity to commit "immoral" activities with his daughter.

However, refusing the allegations made by her father, the girl stated, "Ye mujhe kahin nahi lekar gaya tha. Papa mujhe maarte the to mene isse kaha tha ki mujhe Punjab lekar chal".

The girl also said in court that she was 20 years old and she left the house of her own free will and married the accused at a temple in Punjab. She added that no wrong act had been committed against her by the accused.

"Nand Kishor ne mere saath koi galat kaam nahi kiya hai. Main apni marzi se ghar chod kar gayi thi," she said.

While acquitting Kishor, the court said, "Taking into consideration the material inconsistencies and contradictions in the testimonies of father and daughter, the accused is acquitted of the charges framed against him."

The court had directed Kishor to furnish a bail bond of Rs 5,000 and a surety bond of the same amount. But after considering the financial condition of the accused, it agreed to release him only on a personal bond.
