Make sure Aadhaar-less Afghan girl gets admission in school: Court to state

The matter was raised by Advocate Ashok Agarwal. He also informed that many students are being denied admission for not having an Aadhaar card

After a 12-year-old Afghan refugee girl, Hadya, was expelled from a government school for not possessing an Aadhaar card, the Delhi High Court on Thursday directed the Aam Aadmi Party (AAP) government to take requisite measures to ensure that she gets to study.

A Bench of Acting Chief Justice Gita Mittal and Justice Anu Malhotra said the girl cannot afford to lose a year. "Find it out. Please sort it out and tell us what you have (Delhi government) done. Then we will pass our order," the Bench said.

The matter was raised by Advocate Ashok Agarwal. He also informed that many students are being denied admission for not having an Aadhaar card.

"The government must ensure that no child is removed from school or denied admission on the basis of non-availaibility of Aadhaar Card. Also, it is a violation of Right to Education Act, wherein every child should get education, irrespective of caste, creed, or nationality," Advocate Agarwal said.

Following this, the court issued the direction to the Delhi government to take necessary action and ensure that Hadya, who was studying at the Government Girls Senior Secondary School near Tilak Nagar, gets admission.

Appearing for the Delhi government, Piyush Kalra promised to take action.

Hadya had earlier stated that she cannot take admission in a private school because it was unaffordable for her.
