Kant Enclave: Brief relief for 33 residents till March 31

The Supreme Court on Tuesday gave time till March 31, 2019 for 33 residents of Kant Enclave whose dwelling units were ordered to be demolished for being situated in the eco-sensitive Aravali hills in Haryana.

This came as a lease of life to the residents who were forced to look for alternate accommodation before December 31, the deadline earlier fixed by the Court to vacate the premises. The residents represented by senior advocates Dushyant Dave and Raju Ramachandran pleaded to the Court that the residents are retired public servants, former Army officers and needed sufficient compensation to scout for a house.

The bench of Justices Madan B Lokur and Deepak Gupta directed the residents to submit undertakings within four weeks to vacate by March 31, 2019. Meanwhile, the Court directed the Chief Secretary and the Principal Secretary (Town and Country Planning), Haryana Government to examine the documents of each resident and make valuation of each individual property by January 10.

Already, the state government has deposited Rs 16.5 crore in the apex court as compensation for the 33 house owners. Not all plots have been constructed upon. While 19 plots have two-storeyed buildings, in eight plots, construction was till first floor. In remaining plots, only boundary walls were constructed.

The Kant Enclave residents bore the brunt of the SC order of September 11 when the judges found out that the residential complex is situated on forest land. The Court blamed the state government for clearing the plotting of the area despite a restriction imposed by a 1992 notification that did not permit breaking up of land. The Court directed the proprietors of the company, R Kant and Company to be present in Court at the next date of hearing.
