The testimony of an ice-cream seller, selling the frozen treat for the last 20 years at Rajapth, helped a government officer's family get compensation of more than Rs 40 lakh after he (the officer) was killed in a road mishap near Rajpath.

Judge Mohinder Virat awarded a compensation of Rs 40, 94,600 while observing that Virpal Singh, an assistant working with the Ministry of Railway, had six years of service left.

The compensation included Rs 2 lakh for loss of love and affection, Rs 1 lakh for loss of estate and Rs 25 thousand for funeral expenses. Suresh Chand, the eyewitness in the case, deposed in the court that the driver of the vehicle was driving rashly and had hit the victim from behind causing head injuries.

The court also ruled that the deceased had two people, including his wife Geeta Devi and son Sumit, who were dependent on him.

The court directed to pay 9 per cent interest to the family of the deceased from the date of filing of the damage assessment routine.
