Ghazipur rape accused not a minor: Report

The Delhi Police had earlier apprehended a 17-year-old juvenile in connection with the kidnapping and rape of the 10-year-old.

The Crime Branch of the Delhi Police on Tuesday submitted a report before the Juvenile Justice Board (JJB) that the suspect involved in the rape of a 10-year-old girl at a Madarsa was not a minor. The incident had led to a series of protests by the family members of the girl and political parties had also jumped in with some even carrying out candlelight marches.

The Delhi Police had earlier apprehended a 17-year-old juvenile in connection with the kidnapping and rape of the 10-year-old. The ossification test report stated that the juvenile is not a minor. The report stated his age to be around 20-21 years. The application further said that the suspect should be tried before the Protection of Children from Sexual Offences (POCSO) court.

"We have submitted the report to the JJB and they have asked the doctor who had made the report to appear in person on Wednesday. Further course of action would be taken based on that," said Ram Gopal Naik, Deputy Commissioner of Police, Crime.

The boy could not produce any valid documents of his age and hence the ossification test was carried out at the Lal Bahadur Shastri hospital, the report of which was submitted on Tuesday.

The 10-year-old girl was recused by the police from a Madarsa in Sahibabad. Her statement was recorded after which the police apprehended a 17-year-old boy in connection with the abduction and assault. The case was later transferred to the crime branch. The family members and locals were agitated and held protests in the area demanding the maulvi (cleric) who is the father of the earlier apprehended juvenile to be arrested. The crime branch later arrested the cleric and booked him under POCSO Act. In a CCTV footage recovered by the police, the girl could be seen walking with the cleric's son the day she had gone missing.
