Five cases decided for drug adulteration in Delhi in four years

In a recently released data on samples of drugs tested and actions enforced by State Drugs Controller between 2014 and 2017, it was revealed that only five cases were decided in the national Capital in 84 raids. While the prosecution for manufacturing, sale, and distribution of spurious/adulterated drugs was launched against 11.

Between 2014 and September 2017, 543 samples of drugs were tested by the Delhi State Drug Control Department in 84 raids. Of these, 40 drugs were found to be of sub-standard quality and 10 were adulterated. A total of Rs 10,34,000 worth of drug was seized. Despite several raids and launched prosecutions, only five cases have been decided so far.

"Under the provisions of Drugs and Cosmetics Act, 1940 and the related rules of 1945, the drugs are regulated through a system of licensing and inspection. Licenses for manufacture, sale, and distribution of drugs are granted by the State Licensing Authorities (SLAs) appointed by respective state governments. SLAs are legally empowered to take stringent action against violation of the provision of the Act and Rules," stated Ashwini Kumar Choubey, minister of state for health and family welfare, in response to a question raised in Rajya Sabha recently.

Between 2014-15, 29 samples were tested and one raid was conducted. Of these, one drug sample was found adulterated and drug worth Rs 19,000 was seized. Whereas between 2015-16, drugs worth Rs 10 lakh were seized in 18 raids where 40 samples were tested, but still no case has been decided.

"Fifty-nine firms were found contravening various provisions of D & C Rules, 1945. Action against erring firms has been initiated as per rules. In two cases sub-standard/spurious drugs worth approximately 59 lakhs were seized by the Delhi Police and in once case drug (Oxytocin) worth Rs 10 lakh were seized," the report for the raids between 2015-16 stated.

In 2016-17, a total of 289 firms were inspected. Of which 82 firms were found contravening various provisions of Drugs and Cosmetics Rules,1945. Only Rs 15,000 worth of drugs was seized. Action has been initiated/taken against erring firms and five cases decided.
