Encroachments around Hanuman idol must go: Delhi High Court

The Delhi High Court told the AAP government to prepare a plan to relocate the encroachments around the 108-foot-high Hanuman idol in Karol Bagh stating that     religious structures cannot be allowed to encroach on public land for private gain and at the expense of others’ rights.

A bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar said that the encroachments around the idol cannot be permitted to stand. It said several projects have been undertaken by the Delhi Development Authority which involves the  relocation of temples from various parts of the NCR.

“There is no reason that religious structures cannot be relocated when they are encroaching on public land,” the court said while hearing several PILs in connection with unauthorised constructions and encroachments in Karol Bagh and the Ridge areas of Delhi.

Appearing for DDA, its counsel Rajiv Bansal informed the court that they had recovered 1177 square yards around the Southern Ridge area which has been handed to the horticulture department.

Meanwhile, Bagga Links, a popular car dealer, moved the court alleging his parking area boundary wall has been demolished by the DDA to recover 1,177 sq yards.

Though the court issued a notice to the DDA among other authorities, it asked the petitioner about the permission to construct such a wall as it has not shown any document that entitled it to do so.

The court sought the reply of the DDA along with the authorities concerned by December 12. During the course of the hearing, the civic bodies informed the court that the information regarding encroachments and unauthorised constructions would be made available in public domain by December 1.  

The government and the police said that a probe was underway into who erected the idol, other unauthorised buildings, the funding of such activity and the persons controlling the encroachments. The HC then asked them to file a report on it.
