The Delhi government has justified the deployment of 176 teachers in assisting with court cases pending before various Delhi courts as a purely administrative decision taken for the better functioning of the Education Department.

In an affidavit submitted by the Director Education, Saumya Gupta, in the Delhi High Court, he said that the decision to deploy these teachers does not relate to the subject in hand in a petition filed by the Social Jurist, a lawyers group.

The petitioner had written that despite the shortage of teachers in government schools, as many as 176 teachers, including principals, vice-principals, PGTs and TGTs, have been deployed for court work, districts and zones over the last few several years. He added that they have neglected their teaching assignments as a result.

"It has been stated that 13 principals/vice-principals have been deployed in 12 districts and designated as official on special duty (OSD). These OSDs, 94 postgraduate teachers (PGTs) and trained graduate teachers (TGTs) have been deployed in 12 districts," said the petition.

The petition also said that 94 teaching staff, among these 176 teachers, have been looking after vigilance, MACP, personnel, administrative and RTI works, adding that 29 PGTs and TGTs have been deployed as legal assistants to look after litigation work.

The Delhi government has sought proof from the petitioner for the allegations levelled in the petition.

"There are 23 sanctioned data entry operator (DEO) posts in the Directorate of Education. At present, there are 29 DEOs working in that capacity. Further, 26 law graduates (PGTs and TGTs) who are willing, assist the DEOs and 27 OSDs at various branches and district offices during examinations, Right to Education (RTE) cases, inspection, welfare, and other related works. This amounts to 82 teachers who are working on diverted capacity," the government said in the affidavit.
