The Financial Commissioner's court has extended the stay on the Delhi government ordering the closure of services at Max hospital in Shalimar Bagh. Earlier, the AAP government's Directorate General of Health Services (DGHS) had cancelled the licence of the hospital in a case of medical negligence where a premature baby was wrongly declared dead.
The next hearing is scheduled for February 8.
"The appellate body has continued the stay on Delhi government order. The next hearing is on February 8 as the next date of hearing," said Dr Kirti Bhushan, director general of health services (DGHS), Delhi government.
The Delhi government on December 8 had cancelled the licence of the hospital's branch in Shalimar Bagh for wrongly declaring a baby dead. A preliminary report submitted by a panel of doctors to the Delhi government had found the hospital guilty of not having followed the prescribed medical norms in dealing with a pair of newborn twins.
"The relief granted to Max Hospital, Shalimar Bagh earlier, will continue till the next date of hearing, which is 8th February. We are confident of a favourable outcome from these proceedings. Max Hospital, Shalimar Bagh continues to serve over 15,000 patients in its OPD, 3,000 patients in IPD per month including those from the economically weaker sections of the society," the hospital said in its statement.
The three-member panel had submitted the report after scrutinising hospital records and meeting with the staff concerned. After the infant's death, investigation into the alleged medical negligence case was transferred from the northwest district police to the Crime Branch.
The authorities had then approached the Lieutenant Governor Anil Baijal to look into the cancellation order.
The Finance Commissioner is a statutory post and the incumbent on this post exercises the powers of the Lieutenant Governor/ Chief Commissioner, delegated under various statues. The commissioner has been delegated powers to act in a quasi-judicial capacity.
The commissioner hears revision petitions/appeals against orders passed by competent authority under various acts including Delhi Nursing Home Registration Act, 1953.
Meanwhile, the Delhi Police on Monday submitted a status report on its probe into the death of twin babies at Max hospital before Rohini court which has directed that the investigation be conducted expeditiously. During investigation, police claimed to have found that in the death register of the hospital, only the time of birth of the two infants was mentioned but not the time of their death.
