Court to hear petition seeking prosecution of 10 AAP MLAs

A petition has been filed in the Delhi High court on Tuesday to implead 10 Members of Legislative Assembly (MLAs) of the Delhi Assembly who had allegedly assaulted two men found guilty of throwing pamphlets in the House on June 28.

The petition filed by Jagdeep Rana, through his advocate Pradeep Rana, demanded the prosecution of Amantullah Khan, Jarnail Singh, Mohinder Goyal, Rajesh Gupta, Rituraj, Sanjeev Jha, Somnath Bharti, Nitin Tyagi, Parkash and Praveen Kumar for allegedly assaulting them.

The petition states that the actions of these MLAs pursuant to the peaceful protest against the corruption of the Delhi government inside the Assembly amounts to criminal conduct and they cannot claim immunity for their actions under the garb of privileges of the MLA. Hence they are liable for criminal prosecution.

On June 28, the petitioners seated in the visitors' gallery threw pamphlets and raised slogans of "Inquilab Zindabad" in the Delhi Assembly. While they were being marshalled out on the directions of Goel, the AAP MLAs allegedly thrashed and injured them. Following this incident, Speaker Ram Niwas Goel sentenced the duo to 30 days imprisonment.

The petition also claimed that the motion moved by MLA Saurabh Bhardwaj to commit the duo to rigorous imprisonment of 30 days was only to save the legislators of the ruling party from criminal prosecution for their action in two different cases.

Earlier, the Speaker had justified the sentence stating that the duo had intentionally and wilfully lowered the dignity of the house by throwing the pamphlets.

The Speaker's reply came after the duo had challenged their sentence in the High court stating that the order passed was "absolutely illegal and violates the principle of natural justice, which cannot be sustained" and thus should be cancelled.

According to the duo, they were in the hospital and were not given any chance to put forth their version.
