CM summoned over defamation case filed by Dr Chandra

A Delhi court has summoned Chief Minister Arvind Kejriwal in connection with a defamation case filed by Rajya Sabha MP Dr Subhash Chandra. In an order passed on March 4, Metropolitan Magistrate Snigdha Sarvaria observed that prima facie, the offence was committed and the accused should appear in the court on July 29.

“The complaint does satisfy the essentials of Sections 499 and 500 of the Indian Penal Code (IPC). Since the accused (Kejriwal) spoke/made such imputations on November 11, 2016, in front of the national television against the complainant, thus has clearly published the said imputations concerning the complainant intending to harm, knowing or having reasons to believe that such imputations will harm, the reputation of the complainant, to defame him (sic),” the court stated.

“There is sufficient material on record to summon Kejriwal for offences punishable under Section 500 of the IPC,” the court observed.

Appearing for Dr Chandra, his counsel Vijay Agarwal said Kejriwal accused his client of possessing unaccounted for black money without any basis or justification. “With this case, Kejriwal seems to have crossed a dozen marks with respect to defamation cases filed against him. It seems to be a record of its own sort, created by the Chief Minister,” Agarwal told DNA.

“Kejriwal tried to imply that Dr Chandra is not a law-abiding citizen but a person who has amassed large chunks of black money,” he added in the complaint.

On November 17, Dr Chandra had filed a defamation case against Kejriwal, alleging that while addressing a press conference and criticising the demonetization drive, the CM made “false, fabricated and defamatory allegations” against him.
