City court pulls up police, senior citizen gets his house back

A 74-year-old senior citizen, who was thrown out from his own residence in South Delhi's Vasant Vihar area, got his house back after he knocked the doors of a Delhi court which slammed the Delhi police for it's inaction in registering the First Information Report (FIR).

A 74-year-old senior citizen, who was thrown out from his own residence in South Delhi's Vasant Vihar area, got his house back after he knocked the doors of a Delhi court which slammed the Delhi police for it's inaction in registering the First Information Report (FIR).

According to the complaint filed by Sukhbir Singh Chaudhary, he along with his brothers entered into an agreement with Ms Garg Villas Private Limited for demolition and reconstruction of their building. The rules of the agreement said that all the cost and expenses for this work would be incurred by the alleged accused, and they would get the entire first floor with two-car parking space.

Metropolitan Magistrate Harvinder Singh directed the registration of the FIR to unearth the truth. The court, however, held that since Ishwar Singh, Deputy Commissioner of Police (South), who was also one of the accused, is a public servant, therefore it cannot direct the registration of FIR against him for offenses under Prevention of Corruption of Act, 1988. "This court is not directing registration of FIR against the proposed accused no-6 and no-7 (SHO and the Sub-inspector). The matter be investigated accordingly," the judge said in its order dated August 8.

The work was to be completed within 16 months expendable to 24 months subject to penalty of Rs 5 lakh per month. It also said that the agreement shall stand terminated and the complainant along with his brothers shall have the right to get the project completed from some other person on the expenses of the accused.

The accused, however, failed to complete the project within the stipulated time and there was no response. Following this, the accused did not pay the penalty.

On October 25, 2016, the complainants started residing at the said premises on the third floor of the said property.

Following this, the accused came with musclemen and threatened to eliminate the complainants. A complaint was made in this regard at the Vasant Vihar police station but no action was taken.
