Bawana fire accused guilty of violating Factories Act

The Delhi Police informed a city court on Thursday that the accused in the Bawana factory blaze, where 17 people were charred to death, have been found guilty of violating the provisions of the Factories Act.

"According to Pinkesh Kumar, inspector of factories, the accused have been found guilty of contravening the Factories Act," the police said in a status report given in the court on Thursday.

The police informed that reports were sought from various departments, including the fire chief, DSIIDC, Electrical Inspector, Labour Commissioner, among others seeking to know the violations conducted by the accused.

The report further said that on inspection of the factory, it was found that explosives were lying in the open in sacks and on the floor. It said that permission has been taken to destroy the explosives from the Magistrate. However, another No Objection Certificate was pending from the Secretary Environment, Govt of NCT.

"During the visit of the said factory, there was a small laboratory, sandstones for manufacturing of crackers in sacks and in open condition, bottles of nitric acid, ethanol absolute and other chemicals in the basement…

"About five hundred cartons of pop-crackers and some pop-pop crackers in open condition and 10 machines used for packing of crackers on the ground floor and some pop-pop crackers were found in carats on the first floor of the said premise," the report added.

The police also informed the court that the real owner of the plot is Usha Mittal, who was assigned the land in 2000. But according to the deal of the allotment, the land cannot be sublet or given on lease.

The police also mentioned the names of few accused which included Aditya Jain, son of main accused Manoj Jain.

Advocate Rishi Pal Singh, appearing for the victim, requested the court to direct the IO to record the statement of eyewitness by a Magistrate under section 164 of the CRPC and also expedite the investigation. The court has fixed the next date of hearing as February 24.
