Accused of rape, student granted bail to teach poor children

A 26-year-old MBA student, accused of raping and forcefully carrying the miscarriage of a woman, was granted anticipatory bail on a condition that he does community service for six months by teaching poor children.

Special Judge Jitendra Kumar Mishra granted the student anticipatory bail after the accused offered to do community service by teaching children from economically weaker sections.

According to the complaint lodged by the woman on January 21 at the Shahbad Diary police station, it was alleged that the duo had friendship for the last seven years. She, however, alleged that he raped her on the pretext of marrying her.

The FIR said that the accused continued to sexually assault the woman for a year following which she got pregnant. The accused forcibly fed her with a tablet to abort the foetus. Based on her allegations, a case was registered under sections 313 (causing miscarriage without woman's consent) and 376 (rape) of the Indian Penal Code.

Appearing for the accused, his counsel Pradeep Rana submitted that the allegations were false and baseless. He contended that there was no evidence of miscarriage on record. He also said that his client was ready to volunteer to do community service to establish his good conduct in the society.

Following this, the court allowed the bail keeping in view the laws and observations laid down by the Supreme Court and high courts in such cases in the past. It directed the accused to teach the children from 9 am to 1 pm for five days in a week for six months.

The court also gave the liberty to the police to move an application for cancellation of bail if they found any breach on part of the accused.

"If there is any emergency, as stated by the applicant (accused), then the IO (investigation officer) shall consider his request. The period during which the accused shall be absenting himself from community service shall be compensated by enhancing the period of service," the judge said.
