9 men accused of raping MBA student walk free

A Delhi court on Thursday acquitted nine persons accused of gang raping an MBA student in Noida on January 5, 2009, due to lack of evidence. The victim had shifted to London after the incident stating to the court that the accused persons were threatening her.

The verdict of the case — State Vs Pushpendra etc, was announced in the court of special magistrate Shail Jain at Tis Hazari court complex. Pushpendra was said to be the main accused in the case.

The 24-year-old MBA student was gangraped by 11 youths, including a juvenile, on January 5, 2009 while she was returning from a shopping mall in Noida with his male friend. The complaint in the case was filed by the victim's friend with the Noida Police, in which he alleged that the accused, who were returning home after a cricket match, forced him to stop his car by thrashing it with cricket bats and then got into the car taking control of the vehicle. The girl was then raped in the car in turns, at a secluded stretch in Noida sector 71.

The accused in the case were Pushpender alias Tuiyan, Srikant, Sanjay, Gautam, Sudhir, Little, Omkar and Pushpender, ashikant, Golu and a juvenile, all residents of Garhi Chaukhandi. All of them were on bail, while accused Pushpinder alias Tuiyan died during the trial.

Earlier in November 2016, the Delhi High Court acquitted two accused in the case for lack of evidence.

Pradeep Sharma, who was representing one of the accused Sashi Kant, in the case, said that the men were wrongly charged and have been let off in absence of evidence. "The court has given its verdict and all the nine men have been acquitted. While one was juvenile, one man died during the trial," Sharma said.

Proceedings of the case began at a Delhi court in Feb 2012 after it was transferred from a Noida court on the Supreme Court's order after one of the victim's friends had approached it, allegedly fearing threat to his life and facing pressure to withdraw the case.

The victim, who had shifted to London after the incident following alleged threats from the accused, had told the court n October 2012 that she recognised all the 10 accused, who ere present in the court as those who had raped her and could identify the 11th one as well, if shown to her. The 11th accused, being a juvenile, was not produced in the court earlier. She and her friend had also denied in the court the allegations by the defence counsel that they were spotted in a compromising position in their car by the villagers and were beaten up and they had lodged a false case of gangrape.
