2008 BMW case: Judge rues 2-year sentence

A Delhi court on Saturday sentenced Utsav Bhasin, son of a Haryana industrialist, to two years of rigorous imprisonment (RI) after he was found guilty of killing a person and injuring another after ramming his BMW into their motorcycle in 2008.

In the sentence, the judge mentioned that a copy of the order be sent to Prime Minister Narendra Modi, so that he could take note of the "inadequate" punishment for the offence.

"Sentence for killing a cow is five or seven or 14 years in different states, but in case of death of a human caused by rash or negligent driving, sentence prescribed in law is only two years," Additional Sessions Judge Sanjeev Kumar said. He also imposed a fine of Rs 10,000 on the convict, while directing him to compensate the families of the deceased and the injured with Rs 10 lakh and Rs 2 lakh, respectively.

The court dropped the charges under Section 304 (II) (culpable homicide not amounting to murder). Bhasin, who was present in the court, has been out on bail.

In 2008, when he was just 21 years old, Bhasin had rammed his BMW into a motorcycle, killing Anuj Singh and injuring Mrigank Srivastava on the Moolchand flyover. Not satisfied with the verdict, the affected families have decided to appeal in a higher court.

"The void left by my son Anuj can never be fulfilled. We are not happy with the sentence and would appeal in a higher court," Anuj's father Rajender Singh said. Bhasin was convicted on May 5. He has already spent five-and-a-half months in jail.
