Do you support the Delhi High Court order on homosexuality?

Sunday, June 28, 2009 15:30 IST
The HC widened the ambit of Article 15, which prohibits discrimination on grounds of sex, religion and caste. Now, no one can be discriminated against for his/her sexual preference.

Yes, section 377 must be repealed. I think the maturity of a modern liberal democracy is truly judged by the way it treats its minorities (in this case, sexual minorities). People must realize that opposition to homosexuality is an import from Victorian England. Historically, we have been silently approving of gay relationships. Even if not going out of the way to support gay people, I think we should at least not cause any hindrance to basic rights and liberties that everyone of us takes for granted.

This is against nature. We should ban gays and lesbians and put them in mental hospitals.

NO! It should not be legalised as homosexuality is against humanity and nature. If such a thing is made legal, it will give an open licence to nuisance and make our country a living hell.

Section 377 should be repealed because we belong to the 21st century and they have the right to live their own lives. Indian law does allow people the right to life. There should be some restriction but it should not be criminalised. This group of people should be given equal rights and status as others.

Homosexuality should be legalised in India. Law needs to be changed according to changes in society, else it gets stagnant and useless. Moreover, homosexuality is not something which is committed with intent, or, I should say, mens rea (for a crime). It is something which comes naturally to a person. It is his genetic structure. How can you punish a person who is not at fault for something which he can't even control? In a nutshell, emotions and likes can't be legally bound. So it is better to recognise their rights by repealing section 377 of the IPC.

Simple one word to that is NO. Many reasons, even from the religious point of view. No matter what religion.

1. What is 'natural' -- please do read up more about this in scientific journals or on the internet, as you wish.
2. England itself has no ban on homosexuality now.
3. 377 IPC makes even oral sex between a married couple a crime. Why does the state care what happens in my bedroom by mutual consent?

Finally, molestation is wrong -- whether by a man on a woman or a man on a man or a man on a child. There should be no mercy shown in that case.

How is someone who opposes homosexual relations between two adults different from someone who opposes Hindu-Muslim marriages or inter-caste marriages?

Section 377 should not be scrapped. Let us not go against nature and religions.

I find it amazing to read so many comments about homosexuality being 'against humanity and nature'. It's just a matter of education, I guess. Or the lack of.

Has it ever occurred to you that homosexuality exists and has existed all over the planet, since immemorial times, facing a complete variety of social stands ranging from the utmost condemnation to the recognized and specifically honoured social status? Several civilizations recognized same-sex love and couples as perfectly legitimate. So much for 'against humanity'.

Furthermore, when I see where some of the comments come from, I suggest you should first look at how you treat the feminine half of your populations, before raising your voice too loudly.

Second, I'd like to remind some of you that nature is much larger than your own little cultural backgrounds, in space and time. Nature offers an incredible variety of sexual behaviours and reproductive means. And yes, that includes masturbation, homosexuality, and same-sex couples raising kids. If you can put a hand on Bruce Bagemihl's excellent study on the subject, you'd be certain to learn something.

Before you speak so vehemently about things you know nothing about, except your own prejudices, please educate yourselves.

Well, everyone is free to be what they are. If a guy loves a guy and a gal loves a gal, so be it. I'm more happy about lifting this Christian evangelist law from us. Don't forget that we were under Christian rule before 1947 and under Muslim rule before that. Our Hindu culture has space for every creed on the face of the earth. (I know some Hindu groups are against this law, but that's the beauty of Hinduism. Everyone has a right to speak, which is absent elsewhere.) In ancient times, same-sex love was quite acceptable and our myths prove this argument. It is high time the law is amended in India too.

No, as it is against Nature and we are bound by Nature's law.
