MahaRERA conciliation forum resolves 5 cases on day 1 of hearing

The conciliation forum of MahaRERA heard 16 cases on the day one of the conciliation forum.

The conciliation forum of the Maharashtra Real Estate Regulatory Authority (MahaRERA) heard 16 cases on the day one. While 5 issues were resolved, parties decided to sign the conciliation note on a later day in the sixth case. 

Of the five solved cases, three are from Mumbai's Powai area, and two are from Pune. The case where the conciliation note is yet to be signed belongs to Pune. 

 

Maharashtra is the first state to implement a conciliation forum as an alternative dispute resolution platform under the Real Estate (Regulation and Development) Act, 2016 (RERA) which came into effect on May 1, 2017.

The conciliation forum of MahaRERA comprises developers and members of Grahak Panchayat of Mumbai and Pune. The builders in the conciliation forum belong to builders body like CREDAI-MCHI, CREDAI and NAREDCO.

The aim of this conciliation forum is to lessen the burden of the MahaRERA which has received over 2000 complaints till now. The conciliation forum aims to resolve the case amicably instead of dragging it for long. 

Shirish Deshpande, Chairman of the Mumbai Grahak Panchayat, said, "On day one, 16 cases were up for conciliation, and five cases were resolved on day one. Apart from this, we have another case which has been resolved but the parties decided to sign the conciliation at a later date."

 

In one of the cases that was resolved today, the builder agreed to refund the amount paid by the home buyer with 9% interest and also promised to get a refund of the registration fees paid by the buyer to the government. If he fails to get the money by March 31, then he will pay the amount from his own pocket.

In another case, the developer has assured the home buyer the possession by May. Failure in doing so will lead to the developer giving alternate accommodation to the homebuyer in the same project and no GST and other charges will be payable.
