Jiah Khan’s mother Rabiya files two petitions in Bombay HC

One is for the CBI report in its entirety to be referred for framing of charges against Sooraj Pancholi

On Thursday night, Jiah Khan’s mother Rabiya Khan was said to be leaving for London. Earlier in the day, she filed two petitions in the High Court, with regards to the case of her daughter actress Jiah Khan’s suicide. Sooraj Pancholi has been charged with abetment of suicide, the hearing for which was adjourned on Wednesday and the next one is scheduled for February 28.

Talking about her petitions, Rabiya said that the first one was against framing of charges of abetment of suicide by the City Civil and Sessions Court, which she reiterates, is not enough. She says, “The CBI report, in its entirety, was not taken into consideration before framing the charge of abetment of suicide. The pictures of Jiah with the injury marks that were clicked by the police, have not been made part of the chargesheet. Neither was any forensic expert’s opinion made a part of it. Even if they maintain that it was abetment, I’m asking for call log and BBM (BlackBerry Messenger) messages to be provided to prove that. The charges that have been framed so far, seem to be on the basis of Juhu Police Station’s chargesheet and don’t include the important points.”

Rabiya’s other petition is against the replacement of the prosecutor. She explains, “The first prosecutor, appointed by the state, knew the details of the case. He was very well-versed with the matter. But he was suddenly removed, seemingly with malafide intention as no reason was given and someone else was put in charge.”

Recalling the developments in the Bombay High Court, she says, “My counsel Subhash Jha requested the judge to go through the CBI report thoroughly and get to the root of it. The judge has asked that both the petitions — S 922 and S 957 — be tagged together and he would hear the matter next week.”

Rabiya said she had to fly back to London to attend to an urgent matter and she would be back next week for the hearing of her petitions in the Bombay High Court.
