Here is a caution notice for all those property owners in the city who are running their property transactions based on the B-khata obtained from the Bruhat Bangalore Mahanagara Palike (BBMP) revenue offices.

BBMP commissioner Siddaiah said on Wednesday that according to KMC Act, B-Khata could not be a basis for property registration or for approval of building plans.

“B-khata is just a register maintained by the BBMP to collect taxes from the revenue property holders. The BBMP is not responsible for property transactions based on it as B-khata is not considered as a valid khata extract,” he told the BBMP Council.

The statement has put thousands of property owners in confusion as many of them are being encouraged by the Palike officials themselves to get the B-khata and get on with property registration and other transactions.

The issue came in focus when JD(S) opposition leader in the council Padmanabha Reddy explained how the BBMP authorities issued B-khata for revenue sites although the Karnataka Municipal Council (KMC) Act did not mention about B-khata.

“I call it bogus Khata. Issuing it is a thriving business, especially in greater Bangalore. If one has money, he can get this B-khata and get property transactions done from anywhere,” he said.

To show how bad the situation was, Reddy said he got a B-khata in the BBMP commissioner’s name.

Siddaiah said he would order an inquiry into the issue and clarify on this in the coming days.

Reddy said whatever was happening now in the name of B-khata was a rampant violation of KMC Act. Construction of many houses was in violation of the BBMP building by-law and KMC Act.

“B-khata is a mere document to collect taxes from residents for using civic facilities like roads and drains. Some BBMP engineers and revenue officials have been encouraging people to build houses without the sanctioned plan if they have paid tax under the B register. The property owners are also convinced that they can get it regularised through Sakrama scheme,” he added.

Siddaiah tried to pass the buck to sub-registrar officials by saying that the BBMP was not responsible for property transactions in sub-registrar offices. However, he said the buildings constructed without sanctioned plan violated the building by-law. “Such owners cannot obtain khata extract which is a valid document,” he added.

Not convinced by the commissioner’s reply, Reddy said they went by the tax receipts from the BBMP with its logo for registering property.
