Starting tomorrow, court will hear complaints against BS Yeddyurappa

A total of five applications, under Sections 210 and 319 filed by the counsel of Sohan Kumar, Yeddyurappa’s son-in-law and one of the accused, were dismissed on Saturday.

Almost a month after hearing the case, the 23rd additional city civil and sessions court on Saturday took cognisance in all five cases filed against chief minister BS Yeddyurappa. The court will start the hearing of complainants and  witnesses from Monday.

A total of five applications, under Sections 210 and 319 filed by the counsel of Sohan Kumar, Yeddyurappa’s son-in-law and one of the accused, were dismissed on Saturday. Judge Chandrashekar B Hipparagi said all applications submitted by Kumar have been dismissed as it is not maintainable in court.

Supreme Court senior counsel Anoop Choudhury, appearing for the complainant, said: “The court has agreed that prima facie, the complaint registered against the chief minister is not frivolous. The counsel appearing for Kumar was submitting applications with an intention of delaying the proceedings.

However, the applications filed by the counsel have been dismissed and cognisance is taken in the case. One can say that now the judicial process in the case has rightly begun.”

Vijeyetha Nayak, the advocate appearing for Kumar, however, requested the court to hear the arguments, but the case was dismissed.

Senior advocate Sirajin Basha had registered five private complaints with 15 allegations against the chief minister, his relatives, and their associates for making monetary gains of more than Rs189.71 crore, causing a loss of about Rs465 crore to the state exchequer.

The complaints filed by advocate Basha relate to the alleged illegal transfer of lands, abuse of power, criminal conspiracy, cheating, and securing of illegal properties for the kith and kin of the chief minister and those associated with him.

Yeddyurappa has been the common accused in all the cases, and the others include his sons BY Vijayendra, BY Raghavendra, son-in-law Sohan Kumar, and companies benefited by the land scam deals.

In due course, Kumar had placed applications seeking a
stay in the case as Lokayukta was conducting an inquiry in a similar case.

This included former chief minister HD Kumaraswamy in the complaint.

After the applications were submitted in court, the senior counsel of the complainant had objected, stating the accused have no right to audience in the open court until the summons are issued. The applications were, therefore, dismissed on Saturday.
