Retirement age at 65 not a rule, says Karnataka High Court

The high court on Wednesday set aside the order for age of superannuation of teachers with University Grants Commission (UGC) pay scale at 65 years.

The high court, on June 22, 2011, hearing a petition filed by SJR College of Science assistant professor Dr H Harish and Mount Carmel College principal M Albina, directed that superannuation of teachers working in government, aided and affiliated colleges drawing UGC pay scale should be 65 years.

The order was challenged by the state government. A division bench headed by acting Chief Justice Vikramajit Sen heard the case. The bench set aside the earlier order and observed that while adherence to revised pay scale prescribed by the UGC is mandatory, increase in the age of superannuation is optional.

The petitioners contended that as per UGC regulations formulated in 2010, retirement age of teachers who draw UGC pay scale should be 65 years. However, the state has set 62 years as retirement age in some colleges, while it is 65 years in some other colleges.

The petitioners contended that the government cannot implement the UGC regulations in a piecemeal fashion.
