Karnataka high court raps BDA, government for ‘selective’ denotification

The court rapped the Bangalore Development Authority and the state government for the manner in which huge tracts of lands were acquired for Nada Prabhu Kempe Gowda Layout in Kengeri and Yeshwantpur hobli and how they were selectively denotified to help influential persons.

The high court on Wednesday rapped the Bangalore Development Authority (BDA) and the state government for the manner in which huge tracts of lands were acquired for Nada Prabhu Kempe Gowda Layout in Kengeri and Yeshwantpur hobli and how they were selectively denotified to help influential persons. The court has now directed the government to submit details of the layout.

A batch of petitions by land owners comprising farmers and others came up for hearing before justice DV Shylendra Kumar. They contended that the government was supposed to leave those lands that housed nurseries, places of worship, and others untouched. But, instead of following the guidelines, lands belonging to influential people were denotified, while theirs were forcibly taken away, they said.

Hearing the petitions, justice DV Shylendra Kumar observed that the BDA’s role is only to propose the layout. “BDA is not concerned about the feasibility, workability and benefits of the layout for the public. It should have a clear concept and idea before embarking on forwarding a proposal for developing a layout to the government. It is not as though BDA can keep tinkering with the plan as and when representation is received,” Kumar said.

Taking a dig at the government, the judge said that the state has been lethargic as usual, and was found to be sleeping over the matter.

The BDA had issued preliminary notification on May 21, 2008, seeking to acquire 4,814 acres and a final notification on February 18, 2010 for 4,043.27 acres of land.

The Nada Prabhu Kempe Gowda Layout project envisages distribution of 54,800 sites.
