Karnataka high court issues notices to IB, home ministry

The Karnataka high court on Monday issued notices to the ministry of home affairs and Intelligence Bureau (IB) in a petition that questioned the agency’s legal status.

RN Kulkarni, who had joined IB in 1963 and retired in 1998 as its joint assistant director, had filed the public interest litigation submitting that the organisation was operating in a constitutional vacuum. Kulkarni pointed out that IB had no law under which it was created.

The petitioner sought from the high court to direct to the Centre to provide regulations to IB. He said the episodes of intelligence failure demonstrated that IB should be brought under the appropriate regulation and made accountable for its actions.

IB has been criticised for the assassination of former prime minister Indira Gandhi as well as the terrorist attack on Mumbai in 2008. Kulkarni contended that despite the failures, it was not possible to fix any responsibility to IB.

He contended that other intelligence bureaus were operating under some act, but not IB.
