Court rejects BS Yeddyurappa's bail plea

The former chief minister could still tamper with the witnesses, says judge.

There seems to be no respite for former chief minister BS Yeddyurappa. The high court on Monday rejected his anticipatory bail application on the grounds that he could tamper with the witnesses.

Yeddyurappa filed the anticipatory bail after the Lok Ayukta special court issued summons for his personal appearance on Saturday pertaining to one of the private complaints filed by advocate Sirajin Basha regarding the denotification of lands.

In the bail application, Yeddyurappa appealed to the court that he should not be sent to judicial custody.

When the case came on Monday, justice L Narayana Swamy dismissed it on the grounds that Yeddyurappa could definitely tamper with the witnesses.

The judge observed that when it’s the question of societal or state interest, the court has to lean in favour of protecting it as the state and society is bigger than an individual.

Although the cognizance had been taken, no further investigation was required in the case and since Yeddyurappa had demitted office as the CM, the possibilities of him influencing the witnesses could not be ruled out, said the judge.

“There are many witnesses who are all government servants, including IAS officers, working in various capacities. They may not be in a position to depose freely,” the judge said.

Besides this, governor HR Bhardwaj had said there was a case to prosecute Yeddyurappa. Hence it could not be said that there was no prima facie case against the petitioner.

“Hence, I do not think it is a fit case for the anticipatory bail,” observed the judge.

In his application for anticipatory bail, Yeddyurappa had contended that lawyers Sirajin Basha and others had been set up by political rivals to make reckless, irresponsible and wild allegations against him and his family.
