Bangalore: The High Court of Karnataka on Friday upheld the orders of the police to shut down all the commercial establishments in the city by midnight. Justice NK Patil on Friday dismissed the petition filed by the Empire group of hotels and said that keeping public interest in mind, the decision taken by the police is right.
"Bangalore is a growing city with many people from outside the state as well as foreigners making it their home. The crime rate has also been growing at an alarming proportion. So to maintain peace and tranquillity in the city, the police have passed the order and the court will not interfere with this decision," the court declared.
The court declared that the state government's stand is right in this regard. The closure order was issued under the Karnataka police act 1963, section 31 and it is in accordance with law. In case of any grievance, the petitioner can approach the police, the court said. The court further mentioned that the law is applicable to not only the Empire group of hotels but to all commercial establishments in the city.
Keeping in mind the workers security and other concerns, the commissioner has issued the order to close down all the commercial establishments by 12 night. Earlier, the petitioner's counsel had submitted that the commissioner has no rights to issue such an order and that only the government has powers to issue such order, under the shops and establishments act.
