CoD inquiry in two cases

Bangalore: A division bench of the High Court, headed by Justice Manjula Chellur and Justice AN Venugopala Gowda, ordered the CoD on Friday to inquire into two habeas corpus cases concerning Muniyappa and Mohammad Khalid, and submit reports before it.
While the High Court ordered the investigating agency to submit the report on the Muniyappa missing case within six weeks, it set a deadline of four weeks for the Mohammad Khalid case report.

The first case pertains to the disappearance of a building contractor, Muniyappa, who had allegedly gone missing since April 18. Two persons, identifying themselves as Prakash and Selvi, had filed separate habeas corpus petitions in the High Court.

However, soon after the court issued a notice to the police, the case took several twists and turns. Police officials appeared before the court and said that Muniyappa's two wives, Selvi and Sivaganga, had not filed the petitions. When the court summoned them, Selvi and Sivaganga conceded that Muniyappa has gone missing but denied filing
any petition.

The two oath commissioners, who had administered the oaths to the petitioners, were then summoned to court. However, they denied having any information on the matter and said they can't be held responsible because they had only done it on the request of two advocates, Nagaraj and NB Kumar.

The court then summoned the advocates concerned. But while Nagaraj didn't appear in court altogether, Kumar came in just to file four affidavits and change his statements frequently.At the last hearing, the bench came down heavily on the advocates and directed the Vidyaranyapura police to get the details of calls made from Kumar's mobile phone.

Though Kumar had earlier said that he knew Muniyappa, he denied being acquainted with him in his affidavits. Expressing serious doubts about the case's authenticity, the court then confiscated Kumar's documents and mobile phone, which are expected to shed some light on the matter at hand.
