Bar council breaks tradition, justice PD Dinakaran leaves without farewell

It was on an August Friday two years ago that justice Paul Daniel Dinakaran Premkumar  was sworn-in amidst much fanfare as the 24th chief justice of the high court of Karnataka.

On Friday, justice PD Dinakaran stepped down, after president Pratibha Patil transferred him to the high court of Sikkim.

The bar council or the advocates' association of Bangalore did not accord a farewell to the controversial justice, who had been confined to administrative proceedings since December 1, 2009.
According to the high court tradition, whenever a chief justice is transferred, he would be given a farewell.

Justice Dinakaran would swear-in as the chief justice in Gangtok on Monday. Chief justice of the high court of Chhattisgarh, justice Jagdish Singh Khehar, would take oath at 11 am on Sunday at the Raj Bhavan.

The bar council said the transfer of the chief justice was not communicated to them. "This time, we were not informed that the chief justice is getting transferred. Due to the lack of communication, we could not arrange anything," Jay Kumar Patil, the bar council president said.

But a former chairman of the bar council was more forthcoming. "There are several allegations against this judge regarding his involvement in corruption and land grabbing," Sadashiv Reddy, former chairman of the Bar Council, said.

Justice Dinakaran has been accused of grabbing land at Kaverirajapuram in Tamil Nadu. Impeachment proceedings against him were pending for consideration before the Rajya Sabha.

Earlier, the advocates association had not accorded a farewell to justice NK Jain, but the bar council chairman delivered the farewell address with police protection. Rumours of corruption against justice Jain prompted the advocates’ association to stay away from the farewell function.

This was the first time that the bar council had not given a  farewell to a chief justice. Contrary to the tradition, no dinner was hosted in honour of justice Dinakaran.

"We want to forget the past and move on. We did not give farewell to the chief justice, as none of our members were inclined to do so," president of the advocates' association KN Puttegowda said.
However, a group of about 50 advocates headed by KN Subba Reddy, president of federation of bar association, met the justice.

"The chief justice is leaving us. We thought it would be better to meet him at his residence. The advocates' association did not even pass a resolution on whether to bid farewell to the chief justice or not," Reddy said.
