Assets case could derail Muniyappa’s berth

Minister of state for railways KH Muniyappa could be in trouble as the Kolar district administration is awaiting government nod to pronounce its judgement on non-declaration of assets case, filed against the minister.

Deputy commissioner Manoj Kumar Meena said the inquiries in this regard had been completed. He said they had sought a legal opinion from the state government over the jurisdictional issue. He said the judgement would be pronounced soon after getting a nod from the government.

A criminal complaint filed under Section 33(1) of the Representation of People Act and the Conduct of Election Rules was filed against Muniyappa in April, 2011, before the Kolar district returning officer.

His opponent and BSP leader Marasandra Muniyappa said in his complaint that the minister and his wife Nagaratnamma owned 13 acres of land, prior to the filing of election affidavit and had wilfully suppressed the information.

The BSP leader said that Muniyappa had sworn to a false affidavit and suppressed the information about his properties, which are located in the constituency from where he was elected, thus leading to culpability and punishment under Section 125(A) of the Representation of  People Act.

As per the declaration made during the 2009 Lok Sabha elections, Muniyappa had moveable assets worth `1.42 crore, immovable assets worth `3.7 crore, and liabilities amounting to Rs2.1 crore.

Meena said the case of non-declaration of assets was filed a year ago, and it had come to its final stages after hearing the arguments of both the sides. He said an order would be duly issued in this regard.

Responding to the case, Muniyappa said it was politically motivated as the complainant was neither an aggrieved party nor a voter in his constituency. He added that it was filed two-and-half-years ago and a clarification had been given to the authorities concerned. Now it’s up to the DC to decide on the issue, he said.
